GRADE CROSSINGS - POLICY AND PROCEDURES

As a matter of corporate policy, Conrail discourages the building of any new grade crossings. Furthermore, both federal and state government policy also discourages the creation of new grade crossings. In seeking to carry out this policy, both the U.S. Department of Transportation and state agencies have adopted programs to eliminate grade crossings through the construction of bridges or by diverting traffic to existing overhead, under-grade or at-grade crossings. Conrail fully supports these policies and programs.

In filing an application for a grade crossing, you must first prove - without any doubt - that there is no alternate means of access and that the construction of a bridge is not feasible. Second, you must be willing to: (i) accept the entire liability for the crossing; (ii) provide Railroad Protective Liability Insurance insuring Conrail (limits of not less than $5,000,000.00); and (iii) assume total responsibility for all construction and maintenance costs (including, but not limited to, installation of warning devices as may be deemed necessary by Conrail). You will also need to provide Conrail the following:

  1. A detailed letter justifying your need for a grade crossing.
  2. An application fee of $750 (this is non-refundable charge).
  3. Four (4) copies of a location plan, showing the footage and direction from the center line of the proposed crossing to a Conrail Mile Post, a public street crossing, or any other readily identifiable structure such as a bridge which traverses Conrail's property.
  4. A set of photographs/snap shots showing the proposed grade crossing from all four (4) directions.
  5. The city, county and state in which the grade crossing will be located.
  6. The width of the grade crossing desired.
  7. A detailed list of the number, type and use of the vehicles that will traverse the grade crossing.
  8. The actual hours the grade crossing will be used.
  9. The duration that the grade crossing is needed.
  10. The full name and proper mailing address of the company (including its state of incorporation), municipal authority, individual, or other entity that will be liable for the crossing (Conrail will not enter into an agreement with a Developer). When we have received all of the required information, your request will be forwarded onto Conrail's local Operations for consideration. You will be advised of its decision.

Failure to provide the above information may result in the rejection and return of your application.
